1. Tickets
1.1. The purchase of this ticket (the Ticket/s) by you (you or Your) from the authorised ticket agent, (the Ticket Agent), entitles You to gain entry to the APS Summer Festival (the Event) co-produced by Valletta Cruise Port Plc and National Orchestra Ltd (the Producers) at the venue advertised (the Event Area). Only customers holding a valid Ticket will be admitted to the Event.
1.2. The Ticket is issued subject to the terms and conditions contained herein, as well as those published by the Ticket Agent on their website at embassycinemas.com/terms-and-conditions (the Terms and Conditions). Purchase of the Ticket constitutes acceptance of these Terms and Conditions on Your behalf and on behalf of any person for whom You are purchasing Tickets. In the event of any inconsistency between these Terms and Conditions and those of the Venue or the Ticket Agent, these terms and conditions stated on this website shall prevail.
1.3. The Terms and Conditions are subject to change from time to time without notice and in our sole discretion. We will notify You of changes to the Terms and Conditions by posting them to this website.
1.4. Upon purchase, please check Tickets carefully as errors cannot always be rectified following purchase. Tickets are not issued on a sale or return basis and refunds will not be made on returned Tickets unless otherwise provided under the Terms and Conditions.
1.5. It is Your responsibility to check the Tickets.
2. Data Usage
2.1. The data that you enter will only be used to register for the Event with the Ticket Agent on behalf of the Producers in order to facilitate ticket purchase or other services available. This information is collected and used in accordance with the Ticket Agent’s Privacy Policy which are available on their website at embassycinemas.com/privacy-policy and forms part of these conditions.
3. Changes to Event
3.1. The Producers may add, withdraw or substitute artistes and/or vary advertised programmes, Event times, seating arrangements and audience capacity without prior notice, abiding by current health regulations.
4. Liability
4.1. Neither the Promoters nor the Ticket Agent will be responsible for any damages, loss or injuries incurred at the Event, including loss or damage to property, however caused.
5. Cancelled/re-scheduled Events
5.1. The Producers may postpone, cancel, interrupt or stop the event due to adverse weather, dangerous situations, or any other causes beyond their reasonable control.
5.2. In the event of an Event being cancelled, postponed or unsatisfactory, or in the event that You are not allowed to watch the event for any reason, the Producers and the Ticket Agent cannot be held responsible for any liability including any costs whatsoever incurred by You in connection with the said event.
5.3. Tickets will be refunded (less any booking fees) should the Event be cancelled due to adverse weather conditions.
6. Photography and Recording Policy
6.1. Unauthorised photography, video, audio recording and transmission of any Event, the performers and the performances is strictly prohibited.
6.2. By purchasing a ticket you will be deemed to have consented to being photographed, filmed and recorded. Your image may be used by the promoters in any materials relating to the Event and any future promotions. You will not be entitled to any compensation for this.
7. Restrictions and Prohibitions
7.1. Smoking is not permitted anywhere in the Event Area unless within the designated smoking area (marked on the Event Plan).
7.2. The suggested age for the Live Music Weekends is 5 years and up.
7.3. Age restriction relevant to individual film ratings apply to film screenings.
8. Health and Safety
8.1. If You have any special requirements or concerns about any special effects which may be featured during the Event, prior notice should be provided when ordering Tickets. Special effects may include, but not be limited to, sound, audio visual effects or lighting effects.
8.2. Upon entry to the Event, You will be subject to temperature checks for the presence of fever and anyone with a temperature over 37.2°C will not be allowed to access the Event Area.
8.3. You will be reminded to sanitize their hands with alcohol-based sanitizer from the provided dispenser at the entrances to the Event Area. Floor markings and signage will mark queueing zones and remind users to adhere to social distancing guidelines.
8.4. You will need to keep a two (2) metre distance while queuing to enter the Event Area and will be reminded to adhere to social distancing guidelines as provided by the Superintendent of Public Health.
8.5. You will be advised to walk towards the Event Area following the well-marked pathways available on the quays (marked on the Event Plan) while always requested to follow social distancing guidelines.
8.6. Only upon positively performing the necessary checks, will You be allowed to access the Event Area and are guided accordingly to their respective (pre-designated) seats.
8.7. You will be reminded to strictly stay within their designated seat and adhere to social distancing guidelines.
8.8. Number of seats will not exceed two hundred (200) seats in line with the four (4) square metre per person guideline issued by the Superintendent of Public Health.
8.9. Seating will be in clusters of 2, 4 and/or 6 with a two (2) metre distance between clusters (both side to side and back to front).
8.10. Although not enforced, You will be encouraged to wear a face mask and/or visor during the Event.
8.11. In the event of an emergency, three (3) gates will be available as emergency exits (as marked on the Event Plan). This will also serve as means of splitting the crowd in three (3) groups of less than seventy (70) people (the maximum is seventy-five (75) as per guidelines issued by the Superintendent of Public Health).
8.12. After the Event, You will be requested to adhere to social distancing guidelines on their way towards the exit.
9. Behaviour
9.1. You must comply with all relevant statutes, safety announcements and venue regulations whilst attending the Event.
9.2. You are expected to behave in an appropriate manner so as not to interfere with the enjoyment of fellow festival attendees and should comply with any instructions given by the staff at all times. The Promoters have the right to refuse access or remove any patron who does not comply with the above.
